{"id":4529,"date":"2025-01-22T20:24:54","date_gmt":"2025-01-22T20:24:54","guid":{"rendered":"http:\/\/jimmy.ekota.net\/?p=4529"},"modified":"2025-01-22T20:24:55","modified_gmt":"2025-01-22T20:24:55","slug":"citizenship","status":"publish","type":"post","link":"http:\/\/jimmy.ekota.net\/?p=4529","title":{"rendered":"Citizenship"},"content":{"rendered":"\n<p>Well, I tried to just ignore the rest of the world today. It\u2019s brutally cold and lot of snow on the ground \u2014 good day to just stay in in do nothing. But \u2014 in this day and age, it\u2019s almost impossible to shut the outside world out. Everything on the Internet and news services is about what the new president\u2019s first, and second days were like.&nbsp;<\/p>\n\n\n\n<p>It seems like once again, President Trump is going to give \u201cgoverning by Executive Order\u201d a go. He seems to be hitting on a lot of targets\u2026 wants to rename the Gulf of Mexico \u2014 apparently that\u2019s important to making America great again. But it seems like maybe the one executive order that is drawing the most attention is the one that addresses citizenship by birth or \u201cbirthright citizenship.\u201d<\/p>\n\n\n\n<p>I\u2019ve read the U.S. Constitution more in the past few years than I ever did before. I think it makes it pretty clear that all people born in the United States and subject to its laws are citizens \u2014 regardless of their parents\u2019 immigration status. That principle was recognized by the U.S. Supreme Court more than 125 years ago.\u00a0<\/p>\n\n\n\n<p>If I read the Executive Order correctly, it doesn\u2019t apply to current US citizens, and is not retroactive \u2014 it only attempts to deprive \u201cpersons who are born within the United States \u201cafter 30 days from the date of this order\u201d of citizenship.<\/p>\n\n\n\n<p>Well, I never really thought about it much before and it certainly wasn\u2019t on my agenda for today, but I figured some extensive research was in order\u2026.<br>Like most things, this subject lends itself to making things as complicated as you want them to be.\u00a0<br>But after you sort through everything, it doesn\u2019t <em>seem<\/em> all that complicated.<br>Birthright citizenship applies to all children born in a country that recognizes the principle of \u201cjus soli\u201d (right of the soil,) regardless of the immigration status of their parents.<br>I\u2019m sure there are other categories, but here\u2019s some\u2026<br>Children of Legal Immigrants \u2014 If a child is born in a jus soil country to parents who are legal immigrants (e.g., holding visas, green cards, or permanent residency,) the child typically acquires citizenship by birth in that country.<br>Children of Illegal or Undocumented Immigrants \u2014 Children born in a jus soli country to undocumented or illegal immigrants also gain citizenship at birth. (The 14th Amendment guarantees citizenship to \u201call persons born or naturalized in the United States,\u201d regardless of the legal status of their parents.)<br>Non-Immigrant Visitors \u2014 Birthright citizenship can also apply to children born to temporary visitors, such as tourists, students, or business travelers, as long as they are born on the country\u2019s soil.<br>Countries like the United States and Canada, and many in Latin America grant birthright citizenship universally. But some countries have restrictions, and citizenship might not be automatic if the parents are foreign diplomats or representatives of another government.<\/p>\n\n\n\n<p>It\u2019ll be interesting to see how it plays out, but I\u2019m sure we\u2019ll hear plenty about it and lots of other things on the new president\u2019s agenda.
